WEDDING PHOTOGRAPHY AGREEMENT

TERMS AND CONDITIONS OF THIS CONTRACT

This agreement contains the entire understanding between Molimar Molina Photography as “Photographer” and the above Bride and Groom, known as "Client". The only way to add or change this agreement is in writing, signed by all parties.

RESERVATION AND CANCELLATION

A 25% retainer is needed to secure your date and time of wedding. The 25% retainer is non-refundable in the event of cancellation which would otherwise be unavailable to other clients. The retainer will be applied towards the total amount billed. The remaining balance is due one week prior to the wedding date

PHOTOGRAPHER

The Photographer will be the exclusive professional photographer hired by the Client for the purpose of photographing the wedding. No wedding guests and attendants of the client may impede the Photographer when performing duties, failure to comply may result in missed moments. The Photographer will not be held liable for any shots unavailable because of guest interferences.

DIGITAL COPYRIGHTS

The Photographer retains the copyright and ownership of all images. However, the Client may reproduce or print all the images and may also be used on social media.

CEREMONY AND RECEPTION

The Photographer is limited by the guidelines of church official and venue management. The Client must inform the Photographer with all the restrictions before the wedding date. The Client agrees to accept the technical results of their imposition on the Photographer. Negotiation with the church official and venue management for changes or adjustments of certain guidelines is the responsibility of the Client.

EDITING AND EXHIBITION

All final images will be edited for technical correction by adjusting exposure, highlights, shadows, tone, color, white balance, clarity, and contrast. Advanced Photoshop editing such as removing people or objects from an image, face, and body parts modification or typically anything that requires extensive time, are subject to fee per image, dependent on the amount of editing to be done. The Photographer will be allowed to exhibit selected images resulting from this assignment as an example of work for use on website and social media or as a sample for other advertising, display, publication, or other photographic opportunities.

LIABILITY

In the unlikely event that the Photographer is unable to perform any or all of the duties for any reason including but not limited to; acts of God or extreme weather condition, illness, injury, accident, emergencies or technical problems, a substitute photographer will be provided. If no substitute photographer can be provided, all fees received by the Photographer will be returned to Client and will have no further liability with respect to the contract. This limitation of liability also applies to any loss, destroyed of photographs or failure to deliver photographs for any reason. The Photographer will be responsible for all damages in connection therewith; claims shall be limited to a refund, which should not exceed the total amount paid by Client under this agreement.

FOOD AND BREAK

The Photographer will be allowed a fifteen (15) minutes break at their own discretion and bathroom breaks when necessary. The Photographer will be provided a meal on site, if no meal is provided, the Photographer reserve the right to go off-site for a meal.

FEES AND DELIVERY

All prices are subject to 8.25% Sales Tax. Credit Card and PayPal payments are subject to 3% convenience fee. Make all checks payable to Molimar Molina Photography. In the event the Client fails to remit payment as specified, Molimar Molina Photography has the right to retain all the photos. All edited high-resolution photos will be uploaded to Online Gallery and will be available for download within five (5) to twenty (20) days after the event.
